Elite Interiors Terms and Conditions

POLICIES ORDERING
To place an order or receive pricing please contact one of our sales consultants at 843-449-3588. We will need the correct manufacturer’s name and style numbers; upholstery orders require the fabric name or number and grade. A contract along with a map form and a delivery day form will be sent to you detailing your order. Please check your contract for accuracy of items ordered before signing and returning all requested items. Your order will be placed and delivered as written on your contract.

COM (customer’s own material) orders are subject to a handling charge of $25.00. Please be aware the manner in which the customer’s fabric or other material is applied (e.g., the direction of the pattern, etc.) will be at the discretion of the manufacturer. THERE ARE NO RETURNS OF COM ORDERS FOR ANY REASON. Fabric ordered by the yard is subject to a shipping and handling fee of $25.00 plus $1.00 per yard. Cut yardage is non-returnable.

PAYMENT

A minimum deposit of 50% is required from the customer. No goods will be ordered prior to receipt of the deposit. Payment may be made by Visa, MasterCard, Discover, cashiers check or money order. Orders totaling under $800.00 must be paid in full at the time of the order. Any item that ships directly from the manufacturer such as lamps, accessories, table pads, cut yardage must be paid in full at the time the order is placed.
The deposit is due at the time the order is placed and final balance is due upon receipt of your furniture in our warehouse although in some instances we may be willing to deliver COD with the balance due in certified funds on delivery. If the final balance is not being paid COD Elite does accept payment by approved credit card. In the case that more than one delivery is required to complete your order, the amount due at each delivery will be enough to pay for the items being delivered on that delivery in full. The 50% deposit on all undelivered items must be retained by Elite. Any order that is held in storage for more than 30 days must be paid in full upon receipt of the furniture at our warehouse. Orders held in storage may be subject to a nominal storage fee by the distribution center.
Sales tax must be collected by Elite on all items delivered to or picked up in South Carolina. There may be other states that are subject to a “use tax” on the use of property. Elite is not responsible for any additional taxed charged by any other state and we encourage you to consult with your state and local tax laws in order to determine your tax liability, if any.
Elite’s accounting department will audit all sales tickets. All arithmetic errors are subject to correction. Pricing errors are subject to correction with your approval. If you do not approve the pricing correction, Elite reserves the right to cancel the order.

CANCELLATIONS/CHANGE ORDERS

Customer may not cancel or change orders without prior approval from Elite. Elite can only accept cancellations or changes when Elite is able to make those cancellation/changes with the manufacturer. Refusal to accept an order Elite is unable to cancel with the manufacturer will result in a fifty percent (50%) restocking fee. Requests for cancellations/changes must be in writing and signed by the customer and must be sent by FAX or by mail. All cancellations/order changes are subject to a $25.00 handling fee.
Elite is unable to deliver special ordered furniture on approval.

REFUNDS AND CREDITS

Authorized refunds or credits will be made by our accounting office within two weeks of the authorized date. Refunds or credits will be made in the same manner in which they were received. If the payment received was via credit card, a credit will be issued to the same credit card; no exceptions. Refunds of payments made by cash or check will be issued a company check from the accounting office.

DELIVERY
While most orders are delivered within four (4) months Elite does not guarantee a delivery time frame as many factors including: production schedules and availability of materials, may affect delivery times. Elite is not responsible for manufacturer’s delays.

All orders are shipped FOB Elite’s warehouse and become the customer’s property upon delivery to the carrier. Delivery instructions from each carrier must be adhered to. If no one is home to accept a confirmed delivery a redelivery charge will be imposed. If a confirmed delivery is on a COD basis and the certified funds are not available for the COD charges or for the freight charges a redelivery charge will be imposed.

Local deliveries are subject to a nominal delivery charge.

For all out of state deliveries an estimated freight charge will be given at the time of the order. While Elite will make every effort for the estimated freight charge to be accurate, Elite is not responsible for any difference between estimated and actual freight charges. ANY INCREASE IN COST OF DELIVERY DUE TO SIZE OR WEIGHT OF GOODS OR LIMITATIONS OF ACCESS AT DESTINATION IS THE RESPONSIBILITY OF THE CUSTOMER.

You will be notified when your furniture is received at the distribution center. You are welcome to pick up your furniture at the distribution center yourself or through another service. Any furniture picked up in this manner will be treated as an “AS IS” purchase and may not be returned for any reason. Furniture picked up in this manner is also subject to a nominal processing fee. Delivery on the East Coast is normally within 2 to 4 weeks from the time you are notified your furniture has been received. On the West Coast delivery is normally within 4 to 8 weeks from the time you are notified of your furniture being received. These time frames are estimates only as weather can be a factor in the delivery. Local deliveries for special orders are delivered within 2 to 4 weeks of receipt. Local deliveries purchased from showroom stock are normally within 72 hours.

Delivery is made by two (2) movers who specialize in delivering furniture. The movers travel hundreds of miles and make numerous deliveries. The delivery service will make every effort to meet your scheduled delivery time, but please remember delays may occur due to circumstances beyond the driver’s control. Have your room(s) and pathways to your room(s) cleared and ready for delivery as the drivers cannot move existing furniture. If you cannot be present at the time of the scheduled delivery, please make arrangements to have a responsible representative present to fully inspect and accept the furniture on your behalf. If an item weights over 250 lbs. you are expected to provide assistance in moving it.

If the location of the delivery is not assessable by our delivery truck, it is your responsibility to provide transportation from the truck to the location of delivery. If your order is undeliverable for any reason other than through the fault of the manufacturer or the delivery service, the furniture will not be delivered and you will be charged a fifty (50%) percent re-stocking fee plus freight charges. It is your responsibility to take measurements to ensure the furniture will go through hallways, stairways, doors and will fit into the area which you intend the furniture go. If the movers have difficulty placing an item in the area of your choosing due to limitations such as narrow halls, stairways, corners or ceiling heights, the items will be placed in another area of your home. If you insist the movers maneuver an item in a difficult situation, you will be responsible for any resulting damages to the furniture and the premises. Elite is unable to take returns of furniture that will not fit into the area that is intended to go. The movers are not permitted to set up baby cribs or any items that attach to walls such as mirrors that are intended to hang on the wall. The movers are not permitted to dispose of packing materials and those items will be left with you.

DAMAGED/DEFECTIVE FURNITURE

The furniture sold by Elite is warranted by the manufacturer, not Elite. All merchandise we sell is from reputable companies with excellent quality control, but defective items are occasionally shipped. In most cases, defects are of a minor nature and can be cleared up in the home by a professional furniture technician. Customer agrees to inspect all good for manufacturing problems or failure to conform to the contract description immediately upon receipt of goods. Customer must notify Elite within 24 hours after receipt of goods with any claim of nonconformity or manufacturing problems. As requested by Elite the customer must submit a written claim with photographs within 15 days thereafter. While none of our manufacturers offer refunds for defective furniture, the manufacturer will be willing to repair or replace a defective item as the situation warrants and at the manufacturer’s discretion. Elite’s obligation is limited to repair or replacement at the discretion of Elite along with the manufacturer. For more information see Warranty section.

The delivery company is responsible for all damage occurring during the shipment of the goods (transit damage). It is very important to make sure you inspect your furniture carefully and thoroughly before the driver leaves and before you or your representative sign for the furniture. The drivers can call their customer service representative at the time of delivery for instructions if there is a question regarding transit damage. Do not accept transit damaged furniture. If furniture is damaged (as opposed to defective) note the damages on the Bill of Lading and refuse delivery of the damaged piece. Elite will assist you with respect to transit damages, but this assistance does not imply we will assume responsibility for such damages. Delivery services do not pay for in home repair. If you accept furniture damaged in transit, you are accepting furniture “AS IS”.

Due to the substantial discounts offered by Elite minor door and drawer adjustments as well as minor touch ups are the customer’s responsibility.

LIMITED WARRANTY

The warranty on your furniture is offered by the manufacturer not by Elite. Elite’s obligation as the dealer is to deal with the manufacturer in resolving warranty issues. Most manufacturers’ warranties are for the product to be free of defects in workmanship and materials for a period of one (1) year. The manufacturer will at its option repair or replace the item if the situation warrants. The manufacturer’s decision is final with respect to whether they determine to repair or replace an item. Transit related damages are not covered by the manufacturer warranty. Likewise damages determined to be caused by abuse or negligence are excluded from manufacturer warranty. Manufacturer warranty does not apply to “AS IS” purchases. The manufacturer warranty applies only to the original purchaser and is void once furniture is moved to a location other than the original delivery location.

Natural materials all have inherent characteristics that will cause variations in the finish of the product. These characteristics enhance the beauty of the furniture and are with in industry standards. Color and grain variations in wood can affect how the stain is absorbed from piece to piece and even on the same piece. As a result most manufacturers do not guarantee stain matching on related pieces or various surface stains on the same item. These characteristics are within industry standards and are acceptable.

Leather is also affected by color and grain variations in addition to range marks which can affect how the pigment is absorbed and the look of the leather. These variations and range marks are within industry standards and are acceptable. Fabric is not warrantied in respect to wear ability, color fastness, stretching or shrinking. Due to the difference in dye lots in both leather and fabric, manufacturers are not responsible for any difference in shade variations between the sample swatches and the final product.

Natural products such as stone, marble and granite are characteristically inconsistent in color and veining. These characteristics should be expected and appreciated. Quite often fillers are used to enhance surface beauty. These characteristics are within in industry standards and are acceptable.

Other substances such as glass, mirror, lucite, and metal finish may be subject to small seeds, slight areas of discoloration, minor surface or subsurface scratches. Weld points can be inconsistent and inevitable in furniture crafted of metal. These characteristics are within industry standards and are acceptable.
